Hello COSA Friends,
If you are a municipality with open space lands outside of your city limits, we wanted you to be aware that a new law clarifies that municipal code can be enforced on those lands. Municipal code can be enforced whether the land is called a park, open space, or natural area, and the site can be open or closed to the public.
Previously there was some variation in how municipalities interpreted CRS 31-25-201 preventing enforcement on lands that are closed to the public. Earlier this year, the City of Fort Collins proposed HB 25-1029 and was successful (it passed with a signing by the Governor on March 26th and is now in effect).
